اترپردیش میں ’لو جہاد‘ کے مجرم کو عمر قید کی سزا ہوگی۔ یوگی حکومت نے پیر کو اس سلسلے میں ایک بل پیش کیا۔ یوگی حکومت نے یوپی اسمبلی میں غیر قانونی تبدیلی مذہب ممانعت (ترمیمی) بل پیش کیا۔
وزیر اعلی یوگی آدتیہ ناتھ اور ان کی حکومت ’لو جہاد‘ کو لے کر مسلسل سخت تیور دکھاتی رہی ہے۔ یوگی حکومت نے 2017 کے اسمبلی انتخابات میں لو جہاد کا مسئلہ اٹھایا تھا۔ اس کے بعد حکومت نے اس معاملے میں مسلسل سخت قانون بنانے کی کوشش کی اور اس کی دفعات کو سخت بنایا۔ اب پیش کیے گئے بل کے مطابق عدالت لو جہاد کیس میں متاثرہ کے علاج کے اخراجات کے بدلے جرمانہ طے کر سکے گی۔
اس بل کو لانے سے پہلے حکومت نے بتایا تھا کہ جرم کی حساسیت، خواتین کی سماجی حیثیت اور دلت پسماندہ طبقہ سے تعلق رکھنے کی بنیاد پر سزا کا فیصلہ کیا جائے گا۔ نئے بل میں غیر قانونی تبدیلی کو روکنے کے لیے سزا اور جرمانے میں بھی اضافہ کیا گیا ہے۔ پہلے لو جہاد کے بارے میں معلومات یا شکایت دینے کے لیے متاثرہ، اس کے والدین، بہن بھائی کا ہونا ضروری تھا، لیکن اب اس کا دائرہ وسیع کر دیا گیا ہے۔ اب کوئی بھی یہ اطلاع پولیس کو تحریری طور پر دے سکتا ہے۔ اطلاع ملنے پر جانچ کی جائے گی۔
معلومات کے مطابق اب ایسے مقدمات کی سماعت سیشن کورٹ سے نیچے نہیں ہوگی اور اس کے ساتھ ہی سرکاری وکیل کو موقع دیے بغیر درخواست ضمانت پر غور نہیں کیا جائے گا۔ سبھی جرائم کو قانون کے تحت ناقابل ضمانت قرار دیا گیا ہے۔ اس سے پہلے 2021 میں اسے مقننہ میں پاس کرکے باضابطہ طور پر قانونی حیثیت دی گئی تھی۔ حالانکہ اس وقت اس قانون کے تحت زیادہ سے زیادہ سزا 10 سال اور جرمانہ 50 ہزار روپے تک تھا۔
